Service Packaging Fee (SVP)
The new Packaging Act (VerpackG) came into force on January 1st, 2019, replacing the previously valid 5th amendment to the Packaging Ordinance. Furthermore, as with the Packaging Ordinance (VerpackV) valid until 2018, the first distributor of service packaging (SVP) is obliged to commission a dual system to take back and recycle the packaging for a corresponding payment (system participation). and - according to the quantity - to submit a declaration of completeness for the packaging placed on the market in the calendar year.
According to Section 3 of the Packaging Act, service packaging means: "Packaging for retail, gastronomy and other service providers that enable or support the transfer of goods to the end consumer".
According to the Packaging Ordinance, the first person to place the product on the market is the person who passes on the packaging filled with goods to third parties for the first time within the scope of the ordinance. For example, bakers, butchers or fast-food restaurants are considered to be the first distributors.
What is the packaging law for?
The goals: More packaging recycling in Germany and fair competition!
For the improvement of packaging recycling in Germany and the further development of the circular economy, the Packaging Act focuses even more on the topic of recycling. The primary objective of the Packaging Act is therefore the gradual increase in recycling quotas for the different types of material . From this year, for example, 90% of glass and paper waste will be recycled, and the recycling rate for plastic waste will be increased to 63%, among other things.
Who does the law apply to?
Of course, this law is particularly unavoidable for our B2B customers - so for you! Since the packaging to be purchased from us is considered to be “subject to system participation” and you are defined as a “manufacturer” according to VerpackG, you also have to pay the license fees to the dual system. The underlying fee system is mandatory for you and disregard can lead to a sales ban and high fines. So that this doesn't happen under any circumstances, we would like to help you!
How do I proceed?
Normally this is done in three steps:
1. Obligation to register with the ZSVR
2. System participation in a dual system
3. Data reporting to LUCID
